GENERAL TERMS AND CONDITIONS OF ONLINE SALE

These general terms and conditions of sale govern the commercial relationships between the company (insert company name + address) – France – Siret, hereinafter referred to as the seller, and any individual or legal entity, hereinafter referred to as the buyer, wishing to make a purchase on the website www.cotesetlin.com

The seller reserves the right to modify the General Terms and Conditions of Sale at any time. The applicable version is the one in force on the website at the time the order is placed.

These General Terms and Conditions of Sale are submitted to each purchaser to enable them to place an order.

Consequently, placing an order implies full and unconditional acceptance of the General Terms and Conditions of Sale by the buyer.

No special condition, unless formally and in writing accepted by the seller, may prevail against the General Terms and Conditions of Sale.

Any opposing condition set by the buyer shall therefore, unless expressly accepted, be unenforceable against the seller, regardless of when it may have been brought to their attention.

The fact that the seller does not invoke one of these General Terms and Conditions of Sale at any given time shall not be interpreted as a waiver of the right to invoke any of the said conditions at a later date.

ARTICLE 1: THE BUYER

The buyer must ensure that they are registered with the trade and companies register with valid status at the time of the order.

The seller reserves the right to cancel an order if there is any doubt about the buyer's good faith.

The seller reserves the right to modify their prices at any time, but the products will be billed according to the prices displayed at the time of the order.

ARTICLE 3: PRODUCTS

The products offered for sale by the seller are presented and detailed so that any buyer is able to know the essential characteristics of the products (article L 111-1 of the Consumer Code). The buyer therefore becomes aware of the characteristics of the products sold on the website www.cotesetlin.com and intended for inhalation reproduction. These characteristics and photographs are given for information purposes only and are in accordance with the information provided by the seller's suppliers, the seller not being the manufacturer. The buyer takes responsibility for the choice of products based on the characteristics provided by the product presentation page on the website, the recommendations made, and the certifications. The photographs and texts reproducing and illustrating the products presented are not contractual. Consequently, the seller's liability cannot be engaged in the event of a photograph error, unintentional text errors, or possible special incidents and damages, health or safety issues resulting from the use of the products. The buyer acknowledges using this product under their full and entire responsibility.

The seller expressly reserves the ownership of the delivered goods until full payment of the sale price (law no. 80335 of 12/05/1980). This provision does not cancel the liability clause mentioned below from the moment the order is transferred to the buyer, the seller not being responsible for losses or damages from the moment the order leaves their premises.

ARTICLE 4: ORDER

When placing a first order, the buyer must create an online account with their personal details. The buyer must ensure they keep their details up to date. By confirming their order, the buyer accepts the displayed price and the characteristics of the products presented on the website www.cotesetlin.com By confirming their order, the buyer confirms they have read the General Terms and Conditions of Sale and accepts them without reservation or restriction. No special condition may, unless formally accepted in writing by us, prevail against our general terms and conditions of sale.

The recorded payment information constitutes proof of all financial transactions between the website and the buyer.

This notification is provided for information purposes only. In the event of product unavailability after placing your order, we will inform you by email, mail, or phone. You will then have the option to cancel or exchange your order. In case of total unavailability, the order will be canceled, and a refund will be made if your bank account has already been debited. In case of partial delivery of your order, our customer service will contact you to find an agreement on a possible exchange, refund, or receipt delay.

ARTICLE 6: PAYMENT

The products are payable in full on the day of the order. No discount will be granted.

All orders are expressed in euros, including all taxes, with the applicable VAT rates in France, i.e., 20%.

The order confirmed by the buyer will only be considered effective when the relevant bank payment centers have given their agreement. In case of bank refusal, the order will be automatically canceled.

As part of the fight against Internet fraud, information related to your order may be transmitted to any third party for verification.

The seller does not store any banking information to avoid any risk of card misuse and secure your payments made during purchases on the website www.cotesetlin.com

Payment is made by credit card CB, by bank transfer.

The credit cards accepted on the website are as follows: Carte Bleue, Visa, and Mastercard.

ARTICLE 7: DELIVERY

The products will be delivered to the address indicated by the buyer during the purchase on the website www.cotesetlin.com, which can only be within the geographical area provided (mainland France, Monaco, Corsica, and some overseas departments and foreign countries). The buyer must ensure that their details are correct and complete (notably access code and/or intercom/phone).

Failure to comply with the procedures set out above and below, no claim by the buyer will be accepted.

The delivery of the items is carried out by UPS, Chronopost, DHL. The buyer is delivered by a courier. If the package is delivered against signature, in the absence of the buyer or the recipient of the ordered product, the latter will receive a delivery notice issued by the courier, allowing them to contact the carrier for a redelivery the next working day. After a period of 15 days, the package is returned to the sender. No dispute regarding the delivery itself is possible if the package appears to have been delivered, the carrier's computer system (scanning) being proof via the tracking number assigned.

The goods travel at the recipient's risk, who is responsible for checking for shortages at the time of delivery. In the presence of an apparent anomaly of the package (notably damaged package, opened package, etc.), the buyer or the recipient of the ordered products must not open the package but is invited to make reservations with the courier, on the receipt slip provided for this purpose or on the scanner. The buyer or recipient of the package will then have the option to refuse the package, which will be returned to the sender, or to receive the package while reporting the damage to their package. Opening the "said" package excludes any recourse with the transport company. Any delivery for which the reservations have not been confirmed by registered letter with acknowledgment of receipt within 3 days of receipt to the carrier, in accordance with the provisions of article 133-3 of the Commercial Code, and a copy sent simultaneously to our company, will be considered accepted by the customer. The buyer must also report these incidents to the seller within 48 hours at contact cotesetlin@gmail.com specifying the order number.

Delivery times are given for information purposes only, depending on the availability of carriers and the order of arrival of orders. Our carriers strive to meet the delivery times they indicate when accepting the order and to execute orders, except in cases of force majeure, or circumstances beyond their control, such as strikes, frost, fire, storm, flood, epidemic, supply difficulties, without this list being exhaustive. Delivery delays cannot give rise to any penalty or indemnity, nor justify the cancellation of the order.

Any delay compared to the initially planned indicative delivery times, cannot justify the termination of the order placed by the buyer and recorded by the website www.cotesetlin.com

Delivery costs are automatically calculated in the purchase summary and appear in the total amount to be paid.

When you order several products at the same time, and these have different shipping times, the shipping time of the order is based on the longest time. The seller reserves the right to split shipments.

The seller cannot be held responsible for the consequences of a delay in the delivery of our service provider. In case of a shipping delay, an email will be sent to you.

ARTICLE 8: SHIPPING COSTS

Shipping costs include a contribution to preparation and packaging costs, as well as postage costs. In the event that you think you are buying several items, it is preferable to group them on a single order to pay shipping costs only once.

Shipping costs are borne by the buyer but remain the lowest on the market. For our foreign friends, any customs duties and taxes (on added value) will be systematically added to the order.

ARTICLE 9: CUSTOMS DUTIES

Any order placed on the site and delivered outside of France may be subject to possible taxes and customs duties that are imposed when the package reaches its destination. These customs duties and possible taxes related to the delivery of an item are your responsibility and are at your expense. We are not required to check and inform you of the applicable customs duties and taxes. To find out about them, we advise you to inquire with the competent authorities of your country.

ARTICLE 10: RETURNS AND RIGHT OF WITHDRAWAL

In accordance with article L. 121-20 of the Consumer Code, the buyer has the right of withdrawal of fourteen days from the date of receipt of the product. Returned products must be in perfect resale condition, in their original state (packaging, accessories, instructions...), duly sealed, and accompanied by the order number or a copy of the buyer's purchase invoice. Any risk related to the return of the product is the buyer's responsibility. The seller will exchange the product or refund the corresponding amount by transfer or check, minus any shipping costs, within thirty days.

To return a product, you must first contact us at www.cotesetlin.com specifying the order number and the reference of the products concerned. Once we receive your email, you must send the products to the address provided.

ARTICLE 11: WARRANTY

In application of article 1641 of the Civil Code, you benefit from the legal guarantee against hidden defects and non-compliance defects. Only products with a proven hidden defect can be returned for this reason. In accordance with this article, the customer declaring that their product has a hidden defect must provide proof of it. If the expertise confirms the existence of a hidden defect, the document proving it must be sent to the customer service of www.cotesetlin.com as soon as possible. Upon receipt of the document, a written confirmation and the procedure to follow and the return address for your product will be communicated by our customer service. The return shipping costs of the product are the buyer's responsibility. Acceptance of your return will be made after the hidden defect is confirmed by our services. Once your return is accepted by our services, your product will be exchanged.
